Shiva Internet - Terms & Conditions

" Shiva Internet ", " The Company ", " Us ", " Our " and " We " refers to Midian Technologies (UK) t/a Shiva Internet IT Solutions.

" Client ", " Customer ", " You " and " Your " refers to the person(s), organisation or company requesting services from Midian Technologies t/a Shiva Internet IT Solutions.

" Account " refers to the service provided to you by Midian Technologies t/a Shiva Internet IT Solutions..

" Services " refers to any service provided to you by Midian Technologies t/a Shiva Internet IT Solutions.

All .uk domain orders are subject to Nominet's terms and conditions.

1) A 50% deposit is payable before commencement of any work regarding your web site. The remaining balance is payable after the web site is completed. This must be paid within 14 days after completion of the web site. If payments are late then an interest charge of 12% will be added. Shiva Internet reserves the right to suspend hosting services if you fail to pay the remaining balance. We will not held responsible for loss of business to you or your business concerning your web site.

2) As we cannot say how long a web site will take to build and design. We can estimate that our standard package web site does take about 7 to 10 days to build and design depending on what is required. We have built complex database integrated web sites within 4 to 6 weeks.

2.1) You must supply images and text in order for us to build your web site. Images can be in photo, company brochure or data format, JPG, GIF, PNG. You can also e-mail or post us your images.

2.2) You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.

2.3) You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your web page(s).

2.4) Prices for web packages displayed on the web site are based on general development of web pages. If more work is required to develop a project (bespoke solution) then extra charges will be applied.

3) Hosting is free for the first year. A yearly hosting charge of £100 (inc all fees) is payable to Shiva Internet. This is a flat charge and includes all fees and set up charges. After the date your account expires, You will have another seven days to pay the £100 per year charge. If you do not wish to renew your hosting account, your web site data will be removed from the server. We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services regarding your hosting account.

3.1) Data stored on web servers is not guaranteed to be backed up. It is recommended that you download your web site using FTP. You should back up your web site using FTP. Details on how to do this will be provided by Shiva Internet by request. If in any case servers do crash and your web site data is lost. Shiva Internet will not be held responsible for loss of business to you or your business concerning your web site hosting on servers.

3.2) If you do not pay your renewal fees. Your web site data will be removed once we have notified you by e-mail to make sure that you do not have some important data you wish to keep.

4) After the first year of hosting if you wish to transfer to another company for hosting, This will require for your domain name to have it's IPS tag / name servers changed to the company IPS tag / name servers you are transferring to. You can either do this or Shiva Internet can do this for you for a charge of £10 (all inclusive).

5) Once you have instructed us to build and design your web site and have paid the 50% deposit. Your hosting account will be activated on the same day. Your domain name(s) will also be activated to point to your hosting account. Please note that it can take up to 24 to 48 hours for your domain name(s) to point to your web space

6) All domain names registered by Shiva Internet will be registered for a period of 2 years. All .uk domain orders are subject to Nominet's terms and conditions.

7) By accepting to complete your website Shiva Internet will keep the strictest confidence about information that has been talked about, written or passed over computer discs, CDs etc. Shiva Internet will not release any information concerning your web site to any third party.

8) You may cancel your hosting account at any time and have your domain name transferred to another provider within 30 days of notice of your wish to cancel, however due to the nature of the service and the cost of providing this service, refunds will not always be possible.

8.1) Fees paid for domain name registration are non-refundable.

9) All Charges shall be payable on the due date(s).

10.1) 30-day credit terms are available subject to status.

10.2) If the payment becomes more than 7 days overdue, we reserve the right to find other contact methods for you to try to gain payment, including contacting any e-mail address or telephone number on the website, to avoid downtime for the service(s).

10.3) A 12% interest charge is applied to late payments concerning work with your website or other.

11) We reserve the right to amend and update these Terms and Conditions at any time without notice.

12) You must be 18 years or older to register for the Services Shiva Internet Provides.

12.1) The information you provide to Shiva Internet will be stored on computer. Shiva Internet is committed to protecting your privacy and will never pass on, sell, or otherwise disclose your information to any third party.

13) Although every precaution has been taken in the preparation of this website / terms, the author and publisher assume no responsibility for errors or emissions. Neither is any liability assumed for damages resulting in the use of information contained herein.

13.1) Grants and funding for IT projects are available subject to criteria.
